APPLICANT REQUESTS THAT:

1.  His Date of Rank (DOR) to the grade of major be adjusted to 
10 Oct 12 rather than 12 Jan 13 and his effective date of 
promotion be changed to 25 Mar 13 rather than 17 Jul 13.

2.  He receive all back pay and allowances.

APPLICANT CONTENDS THAT:

Due to an administrative oversight, the Arizona Air National 
Guard (AZ ANG) state headquarters failed to process his 
promotion in a timely manner, causing his name not to be placed 
on the list as a candidate for the Nov 12 ANG Position Vacancy 
(PV) promotion board which had an effective date of 25 Mar 13.  
Consequently, he lost time in grade and military pay.  The 
administrative error at the state headquarters level was beyond 
his control.

In support of his appeal, the applicant provides copies of 
letters from his Military Personnel Flight (MPF) commander and 
superintendent; electronic mail correspondence; his PV promotion 
package and various other documents associated with his 
requests.

Exhibit A.

STATEMENT OF FACTS:

On 5 Sep 06, the applicant was appointed as a first lieutenant 
in the AZ ANG.  On 1 Oct 08, the applicant was promoted to the 
grade of captain in the AZ ANG.

THE AIR FORCE EVALUATION:

NGB/A1PO concurs with the applicant’s request and recommends 
that his DOR be changed from 12 Jan 13 to 10 Oct 12 and his 
Promotion Effective Date (PED) be changed from 17 Jul 13 to 
25 Mar 13.

On 10 Oct 12, the applicant was originally considered for 
promotion to the grade of major; however, due to an 
administrative error, his selection for promotion was not 
processed through NGB in a timely manner.  He was subsequently 
processed for promotion on a later list and was promoted 
effective 17 Jul 13.  

If A1PO had received the original promotion request, the 
applicant would have been promoted with a DOR of 10 Oct 12 and a 
PED of 25 Mar 13 (the date that the Nov 12 ANG PV list was 
approved).

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the 
applicant on 6 Sep 13 for review and comment within 30 days.  As 
of this date, no response has been received by this office 
(Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice warranting 
corrective action.  Having carefully reviewed this application, 
we agree with the recommendation of the Air Force OPR and adopt 
the rationale expressed as the basis for our decision that the 
applicant has been the victim of either an error or an 
injustice.  Therefore, we recommend the applicant’s record be 
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air 
Force relating to APPLICANT, be corrected to show a Date of Rank 
(DOR) in the grade of major (0-4) of 10 Oct 12 rather than 
12 Jan 13 and a PED of 25 Mar 13 rather than 17 Jul 13.
